5. Default. The Flathead County Floodplain Administrator has received the following Floodplain applications:
1. FDP-09-21 A request by Doug Thunker for the placement of riprap along approximately 300 feet of riverbank for bank stabilization in the 100-year floodplain of the Stillwater River. The bank is approximately 12 feet high, and the riprap will be placed one (1) foot above the high water elevation with the remaining portion of the bank stabilized with natural vegetation. The project is located at 254 Anderson Lane, near Kalispell, and is legally described as Tract 2H in Section 09, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana.
2. FDP-09-22 A request by Laurel Fullerton for the placement of riprap along approximately 350 feet of riverbank for bank stabilization in the 100-year floodplain of the Flathead River. The bank is approximately two (2) to six (6) feet high, and the riprap will be placed one (1) foot above the high water elevation with the remaining portion of the bank stabilized with natural vegetation. The project is adjacent to existing bank stabilization on both sides. The rip rap will be angular rock, approximately four (4) to ten (10) inches in diameter, and will total approximately six (6) to seven (7) cubic yards of material. The project is located at 550 Sonstelie Road, near Creston, and is legally described as Tract 1B in Section 28, Township 28 North, Range 20 West, P.M.M., Flathead County, Montana.
Complete applications may be viewed at our office. Written or oral comments concerning the above requests should be directed to the Floodplain Administrator at the Flathead County Planning & Zoning Office, Earl Bennett Building, 1035 First Avenue West, Kalispell, Montana 59901, (406) 751-8200.
Comments should be received by Friday, December 4, 2009. In the event of substantial comment or protest to the issuance of a permit, the Floodplain Administrator may hold a public hearing to determine whether the permit shall be issued.

James M. Thorne and Terry S. Thorne, as Grantor(s), conveyed said real property to Martin S. Invitation for Bids Sealed bids for the following project will be received by the Superintendent of Schools, 501 6th. Ave. West, Columbia Falls, Montana until 4:00 PM December 4, 2009, publicly opened and read aloud on the same day and time in the Conference Room, and taken under advisement. A recommendation to accept or reject the bids will be made to the Board of Trustees at the next regular Board meeting scheduled for December 14, 2009. Replace the existing boiler located at Glacier Gateway Elementary School, 440 4th Avenue West, Columbia Falls, MT 59912. All bids must be plainly marked "Glacier Gateway Boiler Replacement ". The Board of Trustees of School District No. 6 reserves the right to reject any and all bids, to waive formalities, and to accept the bid deemed most advantageous to the School District.
Bids shall be submitted on the form provided with the Contract Documents. The General Contractor and Subcontractors may secure documents by contacting the office of Architects Design Group PC, No. 1 Sunset Plaza, Kalispell, Montana, [406-257-7125] upon deposit of $50.00, refundable when returned within ten days in good condition after the bid opening.
A bid guarantee of ten percent (10%) of the total basic bid shall be submitted with each bid and shall be in the form of lawful moneys of the United States, a cashiers check, certified check, bank draft or bid bond payable to the Columbia Falls School District No. 6, executed by an acceptable surety. A Performance Bond and separate Labor and Material Payment Bond, each in the amount of 100% of the contract sum will be required of the successful contractor. The contractor is to furnish bonds insuring the payment of wages and fringe benefits as required by 18-2-201 MCA.
Each Contractor and Subcontractor will be required to have a contractor's certificate of registration from the Employment Relations Division of the Montana Department of Labor and Industry in the proper classification and be in full compliance with SB 354.
Montana Code Annotated. Title 18, Chapter 1 provides that contracts for construction, repair, maintenance, or providing services to or for the State government or its subdivisions will be awarded to the lowest responsible bidder. However the preference given to resident bidders of this state must be equal to the preference given in the other state or country and must further pay the prevailing wage rates to workers performing labor on the contract if the contract exceeds $25,000.00. Prevailing wage rates are determined by the Commissioner of Labor as provided in 18-2-401 and 18-2-402 Montana Code Annotated. The contractor is required to keep wage records to substantiate that prevailing wages have in fact been paid. Contractors are also reminded that one percent (1%) of each payment due will be withheld for the required Montana Contractors Tax. Under Minnesota law, service of this summons makes the following requirements apply to both parties to the action, unless they are modified by the court or the proceeding is dismissed:
(1)Neither party may dispose of any assets except (a) for the necessities of life or for the necessary generation of income or preservation of assets, (b) by an agreement of the parties in writing, or (c) for retaining counsel to carry on or to contest this proceeding.
(2)Neither party may harass the other party.
(3)All currently available insurance coverage must be maintained and continued without change in coverage or beneficiary designation.
(4)Parties to a marriage dissolution proceeding are encouraged to attempt alternative dispute resolution pursuant to Minnesota law. Alternative dispute resolution includes mediation, arbitration and other processes as set forth in the district court rules. You may contact the court administrator about resources in your area. If you cannot pay for mediation or alternative dispute resolution, in some counties, assistance may be available to you through a nonprofit provider or a court program. If you are a victim of domestic abuse or threats as defined in Minnesota statutes, chapter 518b, you are not required to try mediation and you will not be penalized by the court in later proceedings.

Cahill and Lorie S. Cahill was Grantor, Mortgage Electronic Registration Systems, Inc. solely as nominee for Montana Mortgage Company was Beneficiary and Insured Titles was Trustee. First American Title Insurance Company has succeeded Insured Titles as Successor Trustee. NOTICE OF TRUSTEE'S SALE Reference is hereby made to that certain trust indenture/deed of trust ("Deed of Trust") dated 09/14/07, recorded as Instrument No. 200700029196, mortgage records of Flathead County, Montana in which Jason C. Mueller, an unmarried man was Grantor, JPMorgan Chase Bank, N.A. was Beneficiary and Stewart Title Guaranty Company was Trustee. First American Title Insurance Company has succeeded Stewart Title Guaranty Company as Successor Trustee. Separate sealed Bids will be received by the Jette Meadows Water & Sewer District, c/o Thomas, Dean & Hoskins, 35 Three Mile Drive, Suite 101, Kalispell, MT 59901 until 2:00 p.m., local time, December 11, 2009 for construction of the project described herein. All Bids that have been duly received will be publicly opened and read aloud immediately thereafter at the office of Thomas, Dean & Hoskins.
The project includes construction of a new 200,000-gallon bolted steel water storage tank, two tanker recharge systems, two booster stations, abandoning existing storage tanks, radio telemetry, and pressure reducing vaults. Construction also includes approximately 1,100 lineal feet of 4" water main, 12,000 lineal feet of 8" water main, 2,400 lineal feet of 10" water main, reconnecting existing services, hydrants, valves and other appurtenances.

NOTICE OF TRUSTEE'S SALE TO BE SOLD FOR CASH AT TRUSTEE'S SALE on January 11, 2010, at 11:00 o'clock A.M. at the East door of the Flathead County Justice Center located at 920 South Main in Kalispell, MT 59903, the following described real property situated in Flathead County, Montana: LOT 15 OF ASHLEY PARK, PHASE V, ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND OF RECORD IN THE OFFICE OF THE CLERK AND RECORDER OF FLATHEAD COUNTY, MONTANA Frank J Garcia and Monica T Castaneda, as Grantor(s), conveyed said real property to First American Title Insurance Company, as Trustee, to secure an obligation owed to Mortgage Electronic Registration Systems, Inc., as Beneficiary, by Deed of trust dated October 8, 2004 and recorded October 25, 2004 under Document No. 200429915250 and re-recorded on December 23, 2004 under Document No. 200435809230. The beneficial interest is currently held by CitiMortgage, Inc.. Charles J. Peterson, is the Successor Trustee pursuant to a Substitution of Trustee recorded in the office of the Clerk and Recorder of Flathead County, Montana. The beneficiary has declared a default in the terms of said Deed of Trust by failing to make the monthly payments due in the amount of $1,079.79, beginning May 1, 2008, and each month subsequent, which monthly installments would have been applied on the principal and interest due on said obligation and other charges against the property or loan. The total amount due on this obligation as of August 31, 2009 is $134,425.03 principal, interest at the rate of 4.75% now totaling $9038.41, late charges in the amount of $1002.78, escrow advances of $3611.19, and other fees and expenses advanced of $3049.36, plus accruing interest at the rate of $17.49 per diem, late charges, and other costs and fees that may be advanced. The Beneficiary anticipates and may disburse such amounts as may be required to preserve and protect the property and for real property taxes that may become due or delinquent, unless such amounts of taxes are paid by the Grantors. If such amounts are paid by the Beneficiary, the amounts or taxes will be added to the obligations secured by the Deed of Trust. Other expenses to be charged against the proceeds of this sale include the Trustee's fees and attorney's fees, costs and expenses of the sale and late charges, if any. Beneficiary has elected, and has directed the Trustee to sell the above described property to satisfy the obligation. The sale is a public sale and any person, including the beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents {valid money orders, certified checks or cashier's checks). The conveyance will be made by Trustee's Deed without any representation or warranty, including warranty of Title, express or implied, as the sale is made strictly on an as-is, where-is basis. The sale purchaser shall be entitled to possession of the property on the 10th day following the sale. The grantor, successor in interest to the grantor or any other person having an interest in the property, at any time prior to the trustee's sale, may pay to the beneficiary or the successor in interest to the beneficiary the entire amount then due under the deed of trust and the obligation secured thereby (including costs and expenses actually incurred and attorney's fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default. The scheduled Trustee's Sale may be postponed by public proclamation up to 15 days for any reason, and in the event of a bankruptcy filing, the sale may be postponed by the trustee for up to 120 days by public proclamation at least every 30 days. On Wednesday, December 9, 2009 at 4:00 pm, the Lake County Board of Adjustment will hold a public hearing in the large conference room of the Lake County Courthouse on the following item:
BONNER/HIDDEN CANYON CONDITIONAL USE REQUEST
Hidden Canyon, LLC, represented by Robert M. Bonner, has requested a Conditional Use Permit to allow the disturbance of more than 2000 square feet of slopes greater than 25% on property located within Sub-District C - Upper Highway side of the Upper West Shore Zoning District. Recent road construction activities for access to the property and an intended subdivision of the property have resulted in disturbances of significantly more than 2000 square feet of slopes greater than 25%. The project has an existing approval of a Conditional Use Permit for up to 4.0-acres of slope disturbances, and the applicant is now requesting a modified approval to allow the project's installation of roads, driveways, and utilities to result in the disturbance of 4.7-acres of slopes greater than 25%. The applicant is also requesting clarifications on the conditions and terms of the existing Conditional Use Permit. The subject property totals ±98.03-acres in size and is legally described as Table Bays Block "A" and Tracts 1 - 3 of COS 6575, located in Section 16 of T25N, R20W. The property is located along the west side of US Hwy 93 ±2-miles NE of Rollins, across the highway from the Table Bay Road and Wildwood Trail turn-off.
The complete application and plans may be viewed at the Lake County Planning Dept, Room 315, of the Lake County Courthouse. The Board of Adjustment encourages the public to attend this meeting and voice comments they may have on the proposal. The Planning Dept will accept written comments on the proposal to be included in the information packets sent to the Board of Adjustment. This comment must be received prior to 5:00 pm on November 30, 2009. Written comments received after that time will be synopsized and read aloud at the meeting.
